Chapter 7 and Chapter 13 Debt Relief From an Experienced Lawyer

Chapter 7 is commonly known as a straight bankruptcy. In a Chapter 7, unsecured debt such as credit cards, personal leans and delinquent bills are discharged by the bankruptcy court. Chapter 13 bankruptcy is available to an individual who has too much income or for someone who wants to keep their home and other assets. In a Chapter 13, a portion of your debt will be paid back to creditors over a three to five year payment plan, as determined by the bankruptcy court.

In both a Chapter 7 and a Chapter 13, certain debts cannot be discharged, including:

  • Government student loans
  • Alimony
  • Child support

As soon as you file bankruptcy, you are protected from creditors. Immediately after you file your petition, an automatic stay is issued by the bankruptcy court. This means creditors are no longer allowed to contact you about your debts.
